Things U Need To Know About 99 Year Old Lease HDB

Things you need to know in Singapore regarding properties and their leasehold.

#1 As long as your property is a leasehold unit you are not buying a house. You are buying a lease instead.

#2 Every cent you pour into your lease either through your cpf or cash payments went to the developers or housing department board and then to the state coffers.

#3 What you are then left with is a lease and you are known as a lessee.

#4 This lease has a time limit and expiry date to it and the less time limit it has remaining the more difficult it is for you to sell it to
another buyer.

#5 You only have three basic options once you are in possession of a lease.

One is you transfer it to others in the open resale market before the lease run out.

Two is you live in your leasehold property until the day you died or your leasehold expires.Whichever come first.

Third is you hold onto your lease where it come to a stage where it is no longer possible to sell it off to new buyers and you don’t want to live in it until the 99 year period is up which causes your property value to become zero and wait for VERS lease buyback scheme from the govt to buy back your remaining lease. Most commonly at the lowest average remaining market value evaluation in most cases.

    HDB LEASE IS AN OBLIGATION OF LIABILITY – if you failed of your financial obligation as and when it falls due, IT IS REPOSSESSED by its owner – that is HDB.

    If you paid up fully, you still have to return to its OWNER after the expiry of 99 yr lease.

    IT IS NEVER YOUR ASSET in that 99-yr because the leasor OR OWNER (HDB) even dictate who are the PERMITTED OCCUPIER/S both before and after you completed the financial settlement of your lease MORTGAGE.

    But if you transfer your lease to another party, HDB share part of your gain. If it is yours as owner, PAPpy must be farting gas again that because you keep your profit on sale of your lease, you are that “owner”.

    AGAIN POPPYCOCK!!

    If ever the HDB dwelling is your asset of ownership, its property rights can only be legally transfer to another entity EITHER BY CONSENT of voluntary will OR BY VIOLENCE applied against your will. That voluntary will can be proven of fact and in law by one of these routes

    - a gift
    - a will
    - a sale for value even if it is $1

    And if it is taken away from the lessee by violence, this will be the exact outcome should any of these happen

    - smashing down your HDB door by force, removing you and your contents i.e. repossession or

    - by court order of compliance of vacating the premises otherwise you can be charged for tort of trespass or even criminal offence of burglary if you re-enter to collect your cash, safe deposit box with your legal document or retrieve your crying fear-ridden grandchildren wanting to salvage her doll toy. or

    - by and at the command of the lawful owner (HDB) that you must return the dwelling only to it and no other entity.

    If you can’t will or give away your HDB dwelling even to charity or sell to charity for $1 to prove a valid legal title transfer, IT IS UNAMBIGUOUS EVIDENCE IT IS NOT YOUR PROPERTY AND YOU ARE NOT THE OWNER.

    If after 99-yr lease and use occupation by you and STILL STILL MUST COMPLY BY ORDER OF LAW to return the premises ONLY TO THE LEASOR, the leasor (HDB) is IN FACT OF REALITY AND LAW APPLICATION is the owner.

    THAT IS BASICALLY WHAT PEASANTS NEEDS TO KNOW ABOUT his/her 99-yr lease.

    UNTIL PROVEN OTHERWISE, the lessee is parking his anus there only with the consent and permission of the leasor and that is paid for with 99-yr rental paid in advance.

    SO IS HDB THE OWNER by EXACTLY THE SAME LAW AND LOGIC that it receives part of the sale proceeds and profits of the lessee/peasants, it is AT LEAST A CO-OWNER or in fact the incognito FULL OWNER (since lessee must surrender the premises back to HDB at end of 99-yr lease)?

    BUT IF THE CONTRARY IS TRUE that HDB, having received part of the proceeds and resale levy imposition is NOT THE OWNER, what is the exact relevance of ownership of values embedded in that lease thus sold?

    HIS HDB A THIEF OR A ROBBER? I distaste this supposition.

    Or is HDB is mere SCAVENGER of the wealth of peasants – if they are NEITHER THIEF NOR ROBBER as a result of this resale levy.

    A lot of dumbfarked peasants got trapped by this HDB cobweb of legal entrapment – they DID NOT BUY ANY BTOs from HDB, but as filial sons or daughters, they put their name on the HDB lease to help their jobless fathers/mothers to tide over financially the outstanding lease obligation.

    AS A RESULT OF THIS FILIAL PIETY TO PAPpys fart of “EASTERN VALUES”
    virtues, they are now encumbered by HDB’s invented law that these filial son and daughters are “owners” of a SUBSIDIZED FLAT and when their aged parents dies off, these encumbered sons/daughter seeking to buy a BTO directly from HDB is deemed and treated to make a profit AND TAXED A RESALE LEVY.

    These poor things made no money, HDB MAKES ALL THE MONEY from the filial peasants resale levy but HDB NOW DENIED IT IS THE OWNER and insist the trapped filial sons/daughters as “owners”

    MY SOURCES ARE RELIABLE – if anyone doubts this, go & TALK to your MPs or those who paid resale levy AFTER LOOKING AFTER THEIR AGED PARENTS’ FINANCIAL DISTRESS.

    If anyone ask the HDB spider how it did weave this beautiful cobweb of deceit, I am sure the answer that must come back is this – I DON’T KNOW!

    The more play safe version would be to buy your first BTO and sell it 20 years later when there is still value. Buy another BTO after 20 years for a fresh 99 year lease and let it go when it’s around 15 years old. Take the opportunity to downgrade and hopefully make a small profit as well.

    Of course, this assumes there are enough flats to go around if all emply this strategy. Knowing how PAP works it would not surprise me one bit if they did not allow you to buy a second BTO or came up with restrictions on only being able to downgrade to a smaller unit for your second BTO.

    This issue might jolly well lead to PAP’s downfall. Should it happen the next government must come up with something else since the masses have been conditioned to think their flats will only ever go up in value.

    Considering that you cannot choose the quality of your neighbours, HDB 100m away from common amenities like MRT station should not be priced more than $200,000 * discomforts = ~ $120K to be reasonable.

    Don’t let the garthament, “fry” and maths the price up unreasonably, and you have no choice still have to thanks him for grants.
