Scandalising the Judiciary

I read with regret, the convictions of civil rights activist Jolovan Wham and the Singapore Democratic Party (SDP)’s John Tan over their comments on the State of the Judiciary here. This would not have occurred in other comparable Developed Nations and it is either you’re a First World Country or not, there are no two ways about it or “special” circumstances that require curtailing and frequent amendment of the Constitution to curb civil rights and freedom of speech to point out what is morally wrong in the system!

Are our Judges so incompetent or weak that we need to enact laws to “protect” them as if their judgements are unable to withstand the test or hold weight to scrutiny? Least we forget that the Judiciary as an UNELECTED institution, is potent enough to take away people’s liberties, impose moratorium fines on them or even both remove and interfere with elected politicians and their affairs. The WP MPs are about to have a taste of this soon.

The fact we are an “international arbitration” centre as so often touted by our Law Minister is not because we are really fantastic or have a sound legal system but that no one could ever criticise the judgement, no matter how unfair or unjust it is without risking contempt laws! European nations who arbitrate here are nothing more than hypocrites who criticise dictatorships while wanting favourable legal outcomes through these same authoritarian regimes which protect their interests. I remembered not too long ago that an AG across the Causeway mentioned that Singapore does not have a Constitution.

Lastly, I find it weird and oxymoronic for the same Institution to both try and judge cases involving themselves. It is like, “I wish to complain about you, to you”! How objective can even the most “honest” judge be when deciding cases involving himself or his colleagues? What are the recourse people have if they are wrongly charged by trigger-happy prosecutors or when a wrong decision is made on a particular case?

Moving forward, we have to decide wisely what is at stake during the next polls as our Founding Fathers are no longer around to guide and steer us through tough times ahead and we are already witnessing the multitude of problems and breaches that happened in the short span since the last elections. As it is near impossible to “reform” the other State Organs, we will do well to vote some governing PAP MPs out to ensure proper Checks and Balances and only the most deserving candidates are appointed to lead the various Public Offices in a non-partisan manner before it becomes a situation like Malaysia where all sources of power traces back to one.

    Any professional be it lawyers, accountants, doctors, engineers, journalists etc, who succumb to polanpa, bootlick, brownnose or just plainly ball carrying, are eroding agents of the nation in dispensing justice, financial integrity and honesty, medical treatment and structural and social integrity and safety. It also a source of mockery on national defence and security. This is perhaps what LHY/LWL of compliancy in SIN bureaucracy which was not defended legally in Court of Laws as decreed in unison by the three PMs, one has left the mortal world since then. Perhaps the status and tie has authenfied the claim of solid document evidence which has its effect in not dealing it legally as decreed but the conditions decreed not followed as well.

    Plpism prevails invariably in any regime but when it becomes excessive, things begin to become person based rather than evidence based and laws becomes what they should be depending on who they are applied to. This is what have been taught by honest academics who respect integrity, dignity and professional ethics. Definitely conflict of interests becomes a non issue when a man is successful in his career. When plp is excessive, ludicracy prevails as rationality has gone to blazes. Has SIN reaches the intolerable limits of plpism should be a question in the mind of every nation loving Singaporeans.

    It is surprising why the successful Hourly Glass founder’s daughter can be on drug in the same line of reasoning of Indrandi pertaining to her view that successful man would have no issue with conflict of interests. She should seriously review and defend the successful business woman conviction in relation to drug.

    Anything wrong with such deductive logic or there should be two sets of logics one for those who need to be illogical logic in time of need to plp to be credited for future fortune to roll in like multimillions position.

    hey, your founding father can’t even decides the fate of 38 Oxlee Road, how then to trust even if he is still around?

    I am a average person, but I thought he simply implied our system don’t have a separation of power hence is dependent and not independent? That’s about it. I really cannot understand why so serious making such comment especially there seems to be at least a basis, hence casting a doubt, isn’t it? Basing on my rationalizing, I am also very reasonable average person, don’t you think so.?

    I think to be fair, maybe a vote by the average reasonable persons in TR Emeritus to decide. TR people very PRO gov one.

    But as always, their names and lost can be restored by the good use of the tickets, finally.

    GE coming and in turn we become the BIG JUDGE of the Judges….

    Let’s hope we can be the independent judge ourselves and do it right to correct everything back to order.

    Are there conflict of interests, affecting positions, incomes and livelihoods?
    Who empower those high positions?
    Would it be reasonable for a average Joe to ask such question as if there exist any possible conflict of judgement?
    I ask for knowledge so that I can put a correct vote in coming GE.

    I work for a boss in painting works… I know our quality quite bad…but in front of clients….I’ll say… “Our painting job very good, we many years experience..” normal or not?

    Singaporeans trust our High Court Judges will execute their role without fear or favor.

    They will not fear reprisals from anyone for being just and fair.

    They have worked hard and earned their current appointments; no one can take this away from them and they are never beholden to anyone.

    Hopefully, no one will sue me in Court for declaring the above, thanks!
