The Online Citizen on ‘forced’ indefinite hiatus

The Online Citizen (TOC), one of Singapore’s pioneer socio-political website has been placed on indefinite hiatus, said its chief editor.

Making the announcement on its Facebook page on Tuesday (20th Nov), owner and chief editor Terry Xu said that TOC is currently being investigated for alleged criminal defamation.

Terry also shared that the police have confiscated “desktop, mobile devices and laptops” from his home – equipment which were necessary for the smooth operation of TOC.

“Investigation will take some time to conclude” and there is “no confirmed date of return (of the seized equipment)”, added Terry.

For the time being, said Terry, TOC will be placed on hiatus.

What happened?

Responding to media queries, the police confirmed the investigation into TOC:

The Online Citizen (TOC) article ‘The take away from Seah Kian Ping’s Facebook post’ made serious allegations that the Government’s highest officers are corrupt and that the Constitution has been tampered with. The Police confirm that a report has been lodged (by MDA) against TOC and the author of the article. The Police are investigating this, for the offence of criminal defamation. Electronic equipment such as laptops and handphones were seized in relation to the case.

TR Emeritus understands that TOC had on 4th Sept 2018, published an article contributed by one “Willy Sum” titled “The take away from Seah Kian Ping’s Facebook post’ on its website.

In the article, Willy had, while criticising the current leadership in Singapore, alleged that the Singapore Constitution had been tampered with and that there were also “corruption at the highest echelons”.

The Infocomm Media Development Authority (MDA) then made a police report against both the author and TOC.

Second website accused of criminal defamation

This is the second incidence of  a socio-political website being investigated for alleged criminal defamation.

Barely 2 weeks ago, the Monetary Authority of Singapore (MAS) filed a police report against the States Times Review (STR) for accusing the Singapore government of being complicit in corrupt dealings with Malaysia.

The MDA also issued a notice to STR to take down the offending article, but was ignored by its chief editor Alex Tan, a former Singaporean who purportedly has obtained Australian citizenship.

Subsequently, Mr Tan reportedly setup another website Singapore Herald to replace STR, which has been banned by Telcos in Singapore under order from MDA.

    THANK YOU FOR SHARING, I didn’t know of the illegal “bathroom server” if it exists. But that does NOT support your argument for these reasons. Trump boy could have sacked Comey (and prosecute Hilary too together) on illegality on day one of taking political office in the White House. He didn’t prosecute Hilary nor did he sacked Comey – that debunked his own credibility of integrity. In fact, one could argue that Trump, by inviting Comey to the White House admiration gathering, has been making love to Comey, wanted his backing to protect his own a*se on Russian election interference but found Comey, uncommittal and uncooperative. So as a useless digit of protection against legal hounding, Comey has no value for Trump, SO HE SACKED HIM unceremoniously!!

    Check it out mate, all major bourses in EU and much of the Asian key markets have wiped out all the gains made since 2 years ago when Trump won the White House. US major indices like DJIA, and Nasdaq have wiped out this year’s gain, and financial market is jittery.

    Trump’s tax cut is past its “use-by” date, Democrats control House of Representativee. Obamacare is back, no more crazy stimulus spending on infrastructure, and defence as budget deficit explodes and Feb keep raising interest rate adding to Trump’s woes. Trade tension with China is escalating of division and impact. Trump is looking to end his Presidency in one term only, I suspect.

    Remember this fact? Richard Nixon was impeached and driven out of political office by the Attorney-General he appointed to watch over law compliance.

    That is the standard of law compliance in any democracy. Had the AG in Nixon administration blinked and take side, it would be primae facie corruption, NOT NECESSARY OF MONEY unlawfully extracted and extorted to personal benefit BUT SIMPLY OF CORRUPT CONDUCT in abuse of office and abuse in office at common law.

    If you looked at the corruption definition in NSW, Australia called – Independent Commission Against corruption (icac aCT 1988). Its definition of nature of CORRUPT CONDUCT is spelt out in section 8 of the Act and its legal net is very wide in coverage and capture of all conduct deemed as “corrupt”.

    8 General nature of corrupt conduct

    There can be no doubt Comey’s actions, especially those 11 days before the election, cost Hillary Clinton the election. It is well documented in: “The Unmaking of the President 2016: How FBI Director James Comey Cost Hillary Clinton the Presidency” by Lanny Davis
    Comey basically ignored the FBI election-year protocols. Those protocols were designed to protect the FBI (and basic justice) from the political warring of an election year. He blew those practices off and really undermined the FBI in the process.
    However, I was happy to see him leading the Russian investigation and also demonstrated admirable honor & intelligence in refusing to flatter Trump or accede to his demands & in memorializing those interviews right after they happened. But Comey’s decision to publicly announce why he was not recommending charges against Clinton was just wrong. That’s why Trump fired him. Now the government is crumbling under myriads of litigations caused by the Orange One. It does not require much thinking to see a pattern. What has been a main weapon for Trump for his whole life? To litigate against people who don’t have the means, hence ”winning”. The price of justice, especially in the USA, has become an impossible price to pay for the common man. Does that sounds familiar?
    The apparent freedom to publish anything about an individual regardless of an expectation that reasonable efforts must be made to discover the truth of allegations strikes a lot of us as license, and very dangerous. This is a valid fear.
    There is an enormous difference between suing someone for defamation and slander on the one hand, and the censoring of ideology and political opinion on the other. And in my opinion, if one is going to make accusations of another’s conduct, you’d better have your ducks in a row or else.

    as for Trump’s sacking of Comey, it is hard to tell if Comey refusal to do Trump’s bidding (he claims so) was justifiable at law.

Even if Comey find grounds to admonish Clinton, he might not want to engage in political theatre, it is not his job nor he is prepared to engage in corrupt conduct such to diminish the dignity of the public office of FBI.     Surely this would provoke two things

    - turmoil in global financial market and crashes everywhere and

    - constitutional crisis within the US Government and the Democrats commencing impeachment proceeding against Trump for, maybe for corrupt conduct in COMMON LAW APPLICATIONS, similar to section 8 of the New South Wales ICAC Act 1988.

    Justice Roberts has proven himself to be a reliably rigid conservative who, on occasion, straddles the rails to appear even handed but because he voted in favor of Obamacare, it is hard to imagine that Roberts will save the Court from partisanship. Specifically, the Supreme Court has been swept up in politics intermittently over the course of its history.
    It was Mitch McConnell sublimating democracy, and the Constitution, with some pretty questionable interpretations himself that killed any last vestige of hope that the Court would be non-partisan. He stoked the hyper-polarization of American politics to make the Obama presidency as dysfunctional and paralyzed as he possibly could. The Court is just an extension of McConnell now. Trump is trying to get rid of Roberts as the last remnants of the Democrats.

    Trump is probably salivating at the prospect of screwing up the Fed. I don’t doubt he will find a way to do it. His understanding of economics comes from being born with a golden spoon in his mouth, the gambling industry, real estate gambling, ‘branding’ and TV shows; he knows nothing about manufacturing, distribution, research and development, education, healthcare, infrastructure, supply chains and most of the basics that form the bedrock of a stable and growing economy.
    Trump’s monetary ‘philosophy’ entails zero taxation for business, zero interest rates for business borrowers and a total lack of regulation and oversight for oligarchs, corporations and the powerful.
    We need not wait for the next crisis. The hard prediction is how soon we will see a global economic crisis, and how bad it will get before someone can convince “The People” that it is their beloved Orange One (and Party) who caused it.

    I WROTE THIS TWO DAYS AGO without knowing that the New York State Attorney as servants of the sovereign (not as Trump’s imagined obedient MUPPET private slaves) sued the Trump foundation.

    oxygen: Trump thinks the White House is a blank piece of paper, he paints whatever he likes.

    Trump and his attorneys really think they are above the law i.e. the White House is a licence for him to paint whatever he likes of the law treatment of him.

    The argument that a president is above the reach of state laws sounds ridiculous; Even if that court finds that Trump may not be sued, Scarpulla said, the New York lawsuit might proceed against Trump’s three eldest children and the Trump Foundation itself.
    They shut down his foundation because he and his family were using it as an illegal slush fund. He bought a painting of himself out of the foundation money and spent foundation funds on his campaign, was fined nearly $3,000,000 for abusing this foundation…but all through the campaign he was pointing fingers at the Clinton foundation as per usual accusing them of the things he was actually guilty of.
    Once Trump is out of the White House, and no longer afforded the protection of the presidency, all of his scams and crimes will make him and his nefarious family the target of state and local prosecutors, civil litigants, and the IRS.
    They’ll have a mountain of compelling evidence to work with as they dismantle his criminal enterprises, award compensation to his victims, collect taxes and penalties due. He would no longer be able to hide his crimes.

    Now back to our local context. I found the PAP is repudiating personal rectitude and honest public service, and substituting deprivation, dispossession, and neglect of the legitimate needs of Singaporeans.
    The scary part is that this “first wave” of PAP’s appointments is a low bar to be sure and one cringes at what the next wave of replacements will be like.
    Exhibit number one is a mental vacuum whom they’ve held up for years as their wizard of economics. Exhibit number two, in short, an unacceptable PM. What I am describing, of course, is not just power but the soul of today’s PAP. That’s why our system is stagnating and people are becoming polarized.
    One of these days when politics get bad enough, Singaporeans will realize that they just need to correct this myopic view. Why must our PM be a PAP’s chosen? Just a staunch, dedicated Singaporean with the mettles of Chiam will suffice.
    I find myself even more upset with the bunch surrounding PM Lee, each of them nodding like bobble heads. The lasting, if not permanent damage to the country is frightening to contemplate. It will be administrations (plural) in the future that will have to devote disproportionate levels of effort just to repair the damage done by them.
