Police: Punishment meted to Nicholas Lim is ‘consistent with the approach taken in other similar cases’

The Singapore Police Force (police) has issued an official statement in defense of its perceived lenient punishment meted out to Nicholas Lim Jun Kai, the NUS pervert who was caught filming a female student in the shower.

In a statement released today (23 April), the police said that in considering the magnitude of the punishment, the police and Attorney-General’s Chambers took into account that he was remorseful and had high potential for rehabilitation – citing that no other obscene material was found in his possession.

In aiming to temper punishment and deterrence, the police decided that he would be given a conditional warning rather than face prosecution – which would leave him with a criminal record.

The police said that the punishment is consistent with the approach taken in other similar cases.

Responding to the allegations that the 23-year-old was given a 12-month conditional warning because he has “influential parents”, the police said that the undergraduate’s father is a public transport driver and the mother is a housewife, and that their occupations are irrelevant to the case.

The full police statement:

There have been public discussions regarding the 12-month conditional warning given to a 23-year-old male National University of Singapore (NUS) undergraduate who had committed criminal trespass and insulted the modesty of a female undergraduate at the NUS.

There are two factors (which are both inter-related and yet separate): the first relates to rules to ensure that premises like NUS provide a safe environment, and the second relates to criminal prosecution.

On the first, Police understand that NUS is reviewing its rules, on how such conduct is to be treated.

On the second issue: Police and AGC understand public concerns, on ensuring that our laws and enforcement provide sufficient protection for potential victims, and sufficient deterrence against would-be offenders. That is the approach that Police and AGC take.

In deciding whether to recommend prosecution for a criminal offence, a number of factors are considered by Police in each case, including the age of the accused, the likelihood of reoffending/rehabilitation, the extent of remorse shown, whether there are aggravating factors (for example, like circulation of the offending images).

In this case, the accused was assessed to have a high likelihood of rehabilitation, and was remorseful. There were also additional factors relating to his conduct which were relevant, such as the absence of other obscene materials in any of his devices. A prosecution, with a possible jail sentence, will, likely ruin his entire future, with a permanent criminal record.

Taking into account these factors, he was given a conditional warning, which means that if he commits any other criminal offence within 12 months, he will be liable to be prosecuted for both this current offence and the subsequent other offence. He will then likely face a jail sentence.

Our criminal justice system seeks to temper punishment and deterrence, with giving offenders a second chance to reform, based on assessment of the relevant factors.

The approach in this case is consistent with the approach taken in other cases. There have been a number of similar cases, where such conditional warnings have been given.

Where other relevant factors are involved, for example, a prior criminal record, premeditation to evade detection, there will often be a prosecution.

Allegations that the man was not prosecuted because he has influential parents are untrue – the Police and AGC did not consider his parents’ background. Such factors are irrelevant considerations. It is unfortunate that such untruths have been put out. The man’s parents have agreed for it to be disclosed that his father is a driver in the public transport sector and his mother is a housewife.

The Police are also aware of comparisons being made between this case and a 2015 case involving a 23-year-old man who was charged and sentenced to 10 weeks’ imprisonment for filming a woman showering at Republic Polytechnic (RP).

The accused in the RP case had committed multiple criminal trespass offences, taken deliberate action to avoid detection by covering up the CCTVs in the vicinity and covering his face with a towel, and did not own up voluntarily but was arrested following Police investigations to track him down.

He was a former student of RP and had committed the offences over a period of four months. As such, the Police, in consultation with the AGC, prosecuted him in court. The facts in that case are quite different.

 

Ms Monica Baey

Background

Nicholas Lim, an undergraduate student from the National University of Singapore was caught in November last year for filming a fellow female student, Ms Monica Baey in the shower.

Following a police investigation, Nicholas Lim was slapped with a 12-month conditional warning and a one-semester suspension, which Ms Baey felt were too lenient.

Ms Baey then took to social media on 18 April this year to voice her displeasure and seek redress.

    THE POLICE STATEMENT LEFT A LOT OF QUESTIONS TO BE ANSWERED. Age of “offender” justification? Amos Yee was a juvenile when he was prosecuted. That is also a permanent record. How was he handled after Law Minister said publicly that it is a case for public mind to decide (am I mistaken on this one from social media read of Shanmugam’s stance??) Why should Amos Yee repent to “remorse” (as a relevant consideration to prosecute or not for his young age) when apprehended IF HIS POLITICAL MESSAGE IS WHAT HE BELIEVES IN HIS DEEP CONVICTION – never mind what the rest of the world agreeing or disagreeing??

    And yes, no two cases are exact parallel. The predatory behavior is not proportional of parallel in any two differentiated decisions to or not to prosecute but the ELEMENT OF PREMEDITATION AND THE CRIMINAL CONDUCT THEREON is the same. The logic is that a rape victim is penetrated without consent once or a few times makes no difference in the fact and law that she/he was raped in analogy. The conviction in law courts or otherwise MAKES NO DISTINCTION (ON THE NUMBER OF PENETRATIONS TOOK PLACE) between the accused is judge/found guilty or not. The offender in this case owned up, the evidence is in his phone. No other evidences in his devices elsewhere (home/office) is relevant unless it is for proof of repeat offences of voyeurism of other victims. Lawyers are puzzled why upskirts without consent were prosecuted. And Monica Baey’s sad event circumstances were more serious of her privacy and modesty is violated to exposure much worst than mere “protected covered” upskirts. She was in the shower – totally vulnerable and trapped of no protection.

    Any sensitive prosecution would understand that in sexual offences cases, the worst damage is NOT the offended act occasioned. THIS IS PAST TENSE but the worst thing that continues to haunt the victim’s life is REMEMBERING THAT SEXUAL ATTACK THAT TOOK PLACE.It could end up permanent of flashback mental health damage – SHE LIVES IN FEAR of darkness, lonely present, and seeing the attacker’s face or look alike, or any other matters of similarity reminder i.e. water and showering etc. Did the police statement accord sufficient consideration to this?? The public mind reading the police statement can be the judge.

    THE CASE WAS BADLY HANDLED IN ALL QTRS – UNSYMPATHETIC FROM QTRS MONICA BAEY EXPECTED OF CARE, CONCERN AND PROTECTION. It is like – go and cry to your mommy, we are past that psychological damage.

    Finally, there should be a separate Office of Public Prosecution in criminal law beyond AG – the latter failed. AG cannot be police, law architect and prosecution discretion at the same time.
