Legal Battle with NUS – For the past 14 years, I have fought a tough battle against the National University of Singapore for the wrongful denial of my Master’s Degree. In 2012, I sued the university as a last resort. I am now trying to raise $20,000 for Security for Costs so that my lawsuit can be heard in the Court of Appeal.

Two years ago, donations from the public enabled me to pay a portion of the $11,000 of court hearing fee and send my case to trial instead of being thrown out by Court. I am now trying to raise $20,000 for Security for Costs so that my lawsuit can be heard in the Court of Appeal.

To recap, here below is a brief summary of the past 14 years in which I had fought a tough battle against the National University of Singapore for wrongfully denying my MA degree, the sabotage of my PhD programme that I was then enrolled in in 2006, which cost me loss of career opportunities and loss of income. NUS destroyed my career.

In September 2006, NUS (National University of Singapore) expelled me from the university after refusing to confer me my Master of Arts Degree in retaliation for my whistle-blowing about misconduct by a professor at NUS, and my whistle-blowing about the subsequent cover-up. As a result of this expulsion by NUS, I had to leave a PhD course that I had already started in the United States. This destroyed my chances of pursuing a career in my field of expertise.

In August 2012, I was left with no other option except to turn to the courts to sue NUS, after two different NUS university presidents and the Ministry of Education all failed to help me despite my desperate appeals for help. If I didn’t start the lawsuit against NUS by August 2012, my case would have been “time-barred” which means that I would have passed the deadline to take legal action.

NUS should have properly admitted its guilt, offered to make amends to me, and punished the wrongdoers. Instead, NUS spent more than $700,000 of public funds to hire lawyers to fight me every step of the way and protect the wrongdoers from the punishment they deserved. NUS fiercely resisted discovery of relevant documents, thereby dragging out the lawsuit and making it very costly for me. NUS could afford to use these attrition tactics against me, because NUS can use public funds (taxpayers’ dollars) to fight me in court. I ran out of money half-way through this lawsuit and had to resort to borrowing. NUS even tried to apply to Court to bankrupt me in 2015.

In July 2017, I went public to raise funds for my legal fees after NUS successfully got the Court to issue me two ultimatums (Unless Orders) – to pay $11,000 within three days, failing which my legal case would be thrown out of court. By borrowing money and crowdfunding, I was able to raise the funds to send the case to trial.

In August 2017, the public trial of my case began in the High Court. The trial spanned a total of nine days from August 2017 to November 2017. I blogged about my 9-day trial and legal updates here.

In July 2018, the Court delivered its decision – I lost all my legal claims against NUS. This was despite the High Court finding that NUS was guilty of wrongdoing against me (see the quotations from the High Court’s written judgment below).

On 26 July 2019, the Court delivered its decision on costs – the High Court ordered me to pay $169,748.77 to NUS for the lawsuit (excluding “interlocutory” matters). NUS originally claimed $698,940.11 in legal costs and disbursements for the lawsuit (excluding “interlocutory” matters). This means that NUS claims that it spent at least $698,940.11 paying its lawyers from Drew & Napier to fight me in Court. Since NUS is a “public body” this money must have come from the taxpayers’ dollars.

I don’t know whether if NUS will appeal the cost award, given that the Court has awarded NUS less than a quarter of what NUS has claimed that it had spent in legal costs. Both sides have until 26 August 2019 to file a “Notice of Appeal.” NUS may also choose to bankrupt me as NUS has tried once in 2015 to enforce the cost orders made by Court. This is what NUS does to a student who has refused to allow NUS to cover up misconduct of one of its faculty members against the student.

Having considered the matter thoroughly, I have decided to appeal the High Court’s decision on costs, as well as the High Court’s substantive judgment, to the Court of Appeal; but the problem is that, in Singapore, if you want to appeal to the Court of Appeal, you have to pay $20,000 for “Security for Costs.” If you can’t afford to pay the $20,000, then the Court will not allow you to appeal. The Security for Costs is for the opposing party, which is NUS in my case, and the Security for Costs is separate from the thousands of dollars of court filing fees to be paid to the Court.

As far as I know, the Malaysian Court and the British Courts do not require (or require only minimal amounts for) this sort of security deposit. However, this is, sadly, the current position in Singapore.

Now, in August 2019, I am resorting to crowdfunding again to raise $20,000 Security for Costs which is for the benefit of NUS, before the Court of Appeal would accept my application to hear my appeal.

At the present moment, I have about 2 weeks to raise the $20,000 to appeal the Court’s decisions. I believe I have an arguable case, in fact a strong case, but I don’t have the sum of $20,000. I need to reach the target sum by 22 August 2019 (and file the Notice of Appeal latest by 26 August 2019).

Appealing to the Court of Appeal is probably the only way that I can avoid bankruptcy – or, at the very least, it is certainly the only way that I can possibly avoid a crushing financial burden in the form of the unfair costs order.

Why do I want to appeal?

Some people have asked me to give up taking NUS to the courts because they feel that I can never win a lawsuit against a Singapore public/government institution in Singapore. However, I will still go ahead with the appeal because I believe I have a strong case before the Court of Appeal.

The High Court judgment has already exposed and confirmed wrongdoing by NUS officers.

In the July 2018 written judgment, the High Court actually found NUS to be guilty of wrongdoing in the main facts of my case. (See the elaboration on this point in the next section below.) But the High Court did not find NUS to be guilty of “malice” or “deliberate” acts and, hence, the High Court did not hold NUS liable to me for expelling me from the university and destroying my career, despite the overwhelming documentary evidence that proves that the wrongful actions that NUS took against me were intentional, deliberate, premediated and carefully planned and executed by numerous high-ranking NUS officers.

In my case against NUS, NUS has consistently taken the legal position that I did not complete the requirements that were necessary for NUS to award me my Master’s degree. This is a lame excuse and a red herring. The fact is that I had successfully completed all of the requirements for my graduation and for the award of my Master’s Degree, including researching and writing a book-length Master’s thesis, and I had submitted the final version of my thesis to NUS on the deadline stipulated by NUS. The documentary evidence of letters and internal emails written by NUS officers, clearly prove that the real reason why NUS expelled me and denied me the award of my Master’s degree, was that I refused to comply with demands that I drop my complaints about a professor’s misconduct (my thesis Supervisor), even after NUS sent me a letter that threatened me with expulsion if I refused to comply with the improper demands.

On 13 May 2019, during the court hearing on Costs, the lawyer for NUS, in trying to convince the High Court judge to order me to pay NUS even more costs, told the judge that NUS had made an offer to me to award me my Master’s degree in 2017. (Refer to an extract of the Court Transcript recorded on 13 May 2019 below.)

In other words, NUS has finally (in effect) admitted in Court in 2019 that it had withheld my MA degree despite the fact that I had already earned the degree in 2006!

The High Court judgment appears to be that what NUS did to me is wrongful but NUS is not legally liable to me in the eyes of the law. With all due respect to the High Court, this is absolutely absurd. I will try to ask the Court of Appeal to reverse the costs order. The actions of NUS are “disgraceful” and deserving of “moral condemnation.”

I filed my Notice of Appeal to appeal the High Court’s judgment to the Court of Appeal on 8 August 2018, which was before the deadline; but, the Court has unjustly denied me my legal right to appeal, despite the fact that the right to appeal is supposedly a legal right that belongs to every Singaporean. The Court denied me my legal right to appeal on the grounds that I was unable to pay the $20,000 for “Security for Costs” for the appeal. Now that the High Court has issued a decision on costs, I have another opportunity to be heard by the Court of Appeal, but first I have to raise the $20,000 for “Security for Costs” before the deadline.

    I understand your position. I am not saying you are wrong but you need also be practical and look at your future.

    How long do you want to fight the government? JBJ, CST, TWP, KJ and even the old guard had to stop. Not because the government is too powerful – no – but because the people are too uncaring. You need to understand no one gives a sh*t about your degree or what happens to you.

    if you want to continue what is your likely outcome? Sooner or later you will have to admit defeat. It is not your fault. But you are behaving like this is America and the people will support you. Evidently you have been watching too many TV movies like “law and Order’.

    You have one life (as far as I know). Do you want to spend the better part of your youth banging your head against the wall? For what? You gain nothing.

    Be smart. Move overseas. I am sure you can do it. Get a degree in an Australian or UK university and move there. Forget about this vendetta which you will regret in your middle and old age.

If you were threatened with bankruptcy, would you just give up and surrender without a fight? Would you just give up if you were being victimised the way NUS victimised me?

    If you need someone with deep pockets, I suggest you try Lee Hsien Yang! Don’t even bother with crowdfunding.
    And before you can be served your bankruptcy papers, try to think out of the box to save yourself!
    Go to a Western democracy & ask for political asylum. If you’ve got enough evidence to show that the political mechanism isn’t fair to you & prevents you from a fair & impartial hearing. Think of how Amos Yee played the PAP govt like a violin to gain the judge sympathy for political asylum in the US. But the US under Trump isn’t an option for political asylum now.

    I am an old person and have gone through the early years when the old despot was in charge of this communist island. I have been in worse situations than you can imagine. I am still paying the price of someone else’s vanity – and will continue to pay for it until I die.

    You need to refocus your priorities. If you are bankrupt there are options. But not if you lose your future, which cannot be regained.

    You are already a troublemaker to the police state. Once that happens you will be followed and discriminated against for a very long time. I know because I have seen it happen.

    I only ask you look at options to leave and start again somewhere else. It may be you can get your judgement overturned but you need to be realistic. Either way you need to restart elsewhere.

    I can see it. You’re walking in a very dark street with the fallen one whispering all the wrong things while blocking your ears and eyes to see the flatten path ahead and dragging weights onto your feet. It means, your luck is at the lowest, the baddest now.

    You need to waste that 3 yrs and 2 more to shine back.
    Asylum sounds good, but in the dark alley…… you know the result..I don’t want to say it..

    You fought, you must take punches. You must know how to shift your stances.

    My advice, take this punch, will not kill you, yes it hurt badly, so bad, we feel for you. Right this hour even, I’m, we’re with you.

    Take the installments plan, ask for the release of the master degree, pay the shit, 5 yrs later, fight back in another better way, be in parliament to change things, or be president to vest everything….

    I agreed with earlier posters. In sg system, chances of u winning s very slim. By going for the appeal, u are just delaying the inevitable and increasing the final cost that you have to pay.u are just throwing good money after bad. It will be better u do crowd funding to Pay off the debt and get your your degree they offered plus both parties paying their own cost if their earlier offer still stand.

    I have seen many I injustices in life but justice in sg needs money to see justice as the court processes are expensive. So no money no justice and this is the reality of life here.

    I like your courage and determination and I think you are right. But you know Singapore is a dictatorship, the govt machinery often glues itself together. To me this is a simple case, it should not even take 1 day or 2 to conclude. They will drag you out until you give up because you ran out of time and money.

    I suggest few options for you:-

    1. Look for dishounourable son brother – he seems willing to help people with justice in mind, this case is another classic heavy hand.

    2. Apply to migrate out of SG.

    Singaporeans are mostly selfish, as long as they are not hit, they are fearful of change and PAPPY. Let them enjoy the pain and with foreigners taking over this country, SG will no longer be the same.

    Take the advice of people who have eaten lots of salt; what misconduct has this Nus professor done.use some of yr materials?forget it move on before you ruin yr life both financially socially and cause sadness to yr family ,life is never fair there are always diff shades of gray.

    Do not bother to crowdfund ; we are in a recession ; unless yr Father is a mp or minister the Govt or Nus is not bothered;even if I have money to spare I rather help the opposition who are now struggling to survive.

    This research material that the Nus prof used accord to yr past revelation does it have any commercial value or implication .?if it is just some matter of academic interest people just read it and forget;10 Yrs fr now everyone has forgotten; it is not going to make slightest diff.

    I studied at the old univ of spore campus and know the system well ; they take care of their kind and I spend 4 of my unhappiest and loneliest Yrs there and try forget it; I can only empathise

    Holding jobs unrelated to my field; in my last Yrs now 72 and just trying make myself as comfortable as possible;

    I did not have ex lawsuits ; if you go on this way u will have a tough old age.

    The system is to protect them not you.
    This is the legacy of the old fcuk.
    The purpose is to discourage serfs from seeking justice or equality, to exhaust and drain you of funds and fighting spirit.

    My story is the same as many others here – ask anyone over 60 – when the pappies came to power and how they did it.

    I am just one of many from that time who have been screwed. Our only crime was being born in $G at that time. No point talking too much. The younger ones here will have to learn the hard way.

    You are a good person and I like your posts. I am being realistic based on my own life and experience – and based on others whom I know suffered a similar fate to Ms Ten

    I believe many people have not seen the depths this government will go to punish anyone who they feel is a threat to them. Note I did not say if the situation is right or wrong. That does not exist in $G.

    In my view – and I am entitles to my view based on my own past – this young lady will not have a good life even if the Court of Appeal overturns her decision.

    I knew JBJ personally. It broke my heart to see him tying to sell books at City Hall MRT and no one cared. Ask Mr Chiam and Mr Chee how their lives are. They have chosen this path and are heroes.

    This young lady should not be used as a pawn by people just to score points for their cause against the government. Her life is important and has value – or else what is the opposition fighting for?

    Perhaps she still believes that the system will work for her. Fair enough. But she can only make a decision if she knows both sides of the coin and the cost it puts on her and her family.

    At the end of the day none of us will be there for her. She has to walk alone. I do not want to send her down a path that would ruin her.

    when 3 pap leaders were caught in pap law, the interpretation is, INSIDE 200m is not within 200m.

    when one of us had a case against an army fellow during NSF, the CO said, if you withdraw indictment, we ensure the army fellow disappears from view but if you insist on indictment then all of us fight against you. of course as NSF with S$90 per month, withdrew but fair is fair the army fellow disappeared from view not even seen when ROD.

    So.

    So those who egged her to fight, do support with S$m too. otherwise, we shall be the biblical folks who tell the poor to eat well and to keep warm without providing food nor clothing. in that case, no different from pap hypocrites.

    Facts that are presented and concluded in lower courts would not be reconsidered for its factual merits but for its legal merits.

    Is it worth it to go through with court of appeals?

    How to tell if the govt is stalking and/or harassing you:

    1) People who’ve known you a long time suddenly become very cold, unfriendly or hostile to you for no reason. They might hint at something or quote/paraphrase something you said about the govt.

    2) Shops and places yu visit regularly act funny. Like they don’t want to do your business. They dilly dally when serving you or give you attitude. Like they don’t act normally.

    3) Both local and foreign Celebrities and singers whom you admire – say things in public media that allude to your situation. They do so in such a way that only you undertsand. It would be lost on others.

    4) People try to block you way, bump against you in public. I’m saying it happens in non crowded places.

    5) People running past you very quickly and in an aggressive manner.

    6) Suddenly a lot of regular renovation work around your residence. People slam car doors loudly downstairs and noisy interlopers that are always doenstairs your place.

    7) If you travel by public transport, groups of people always want to sit and stand near you and talk/laugh loudly or allude to something you said about the govt. They are just rying to irritate you.

    8) Police cars always seem to be near you when you are taking the bus and or park somewhere.

    9) YOu get a sense of being followed. Those people act “Gwai gwai she she”. Cantonese for behaving suspiciously. They waer all black with dark glasses so you won’t recognise them.

    10) Your relatives and friends show disapproval and bad attitude towards you and drop hints. Previously they were very nice to you.

    11) Over time, you realise all sorts of people try to irritate you. Old, young, working,, students of all ages, straight, gay, local foreign.

    12) If you are in gyms, swimming pools, they always do cleaning when you are around. They might send contractros into the sauna rooms when you are relaxing. They might send staff of opposite sex when you are in the changing room.

    13) They get cleaners to park their trolleys next to you at hawker centers. Even if there are other places they can park.

    14) Your friendly neighbors start to act weird. They become unfriendly hostile and try to drop hints or scared to talk. They purposely create noisy disturbance near your place or outside.

    15) You neighbor upstairs will flush the toilet whenever you go in at differing times. Or make nosie just above you which ever part of the apartment you are in. The govt probably got spy cameras watching your movements in you flat.

    16) You get fired from jobs for lame reasons. You sense that thay can’t wait to get rid of you. Job interviwers will insult you.

    You are forgiven for thinking these are small things and that you are over sensitive and/or paranoid. But…

    But these things ( one or a few mentioned) happen on a daily basis. So trust your intuition and sixth sense. Because before you made those comments and/or pissed off the govt, your life was pretty good then.

    Justice is the only consistent mission of human civilization. International praise for Singapore has been hoodwinked by internationally well known “good exterior (usually created n sustained by money Power) rotten interior or the favorite both in thr rast n west ‘wolf cladded with sheep skin. Howver it is the saddest record in humam civilization that deliverance of justice ismometary n it happens in Singapore. In other , no money no talk of justice. So if a woman is raped n killed, she would get justice if her family is rich n if she cannot pay, the system implied she derserves it.
