Use of maid to clean the office

Mr. K employed a maid for his 4 room HDB flat. He runs a small office nearby to operate a small business. It is his main source of income.

He asked his maid to clean the office once a week and paid her an allowance for the additional work. This arrangement worked well for some time.

Later, there was a misunderstanding between Mr. K and her maid. She threatened to report to MOM that Mr. K had used her to clean the office, which was not allowed under the MOM approval letter.

Mr. K had no choice but to pay her a compensation (amount not disclosed) to avoid getting into trouble with MOM. Mr. K sent the maid back to her country.

Mr. K was disappointed that the restrictive terms imposed by MOM had caused him to be in trouble. He considered that his small office to be an extension of his home. The maid did not have to spend much time cleaning his small HDB flat anyway.

Prior to appointing the maid, he had agreed with her that she should clean the office and be paid an allowance. Later, she used it to put him under ransom.

Mr. K felt that MOM should be more flexible in the approval letter and allow him to treat his office as an extension of his home. After all, the maid spends only 2 hours a week to clean the office.

Should MOM be more flexible to allow the maid to be used outside of the main place of work provided that the time spent is kept at less than 8 hours a week, i.e. 20% of the normal working hours?

    Your friend’s maid may be happy to work for a slave driver, NOT A SLAVE OWNER. The slave-owner unilaterally dictate terms whatever he/she wishes to vary of agreed contract terms.

    AN EMPLOYMENT CONTRACT is NOT a business contract or contracts with constant revisions of terms of consent agreement at the whim and fancy of the slave owner.

    IT IS SIMPLY A MASTER-SERVANT RELATIONSHIP which either parties CAN TERMINATE without any reason/s assigned to the other.

    If your friend treat it as a strictly variable business contract and the maid treat it as exploitative of her momentary weakness of bargaining position, she will EXTRACT VALUE at the end of the contract conclusion.

    IN CONTRACT LAW, IT IS TANTAMOUNT TO THE BATTLE OF FORMS outcome, the last “agreed” term/s – willingly or unwillingly conceded – apply.

    Can Mr. Tan KL enlighten us that if the maid has an accident, serious injury or died when working “outside the main place or work”, what are the consequences? If an office can be an extension of home, then other people will insist that a shop or an eatery or a worksite or any other places can be an extension of their home. If Mr. Tan wants to clean his office, please engage proper cleaners or else everyone will be out of jobs.

    Once the law is bend, it will be misused by employer. Today, MOM will allow you to clean the office, and you started to set up two or three and even more offices down the road and expected the same maid to do the same? Don’t forget, the maid are working on pittance salary. Why stretched her over every free time she has? Besides, unlike other workers, house maids do not have much benefits – No MC, No annual leaves, no 44 hours work limit. What is the max capacity can you squeeze out of her?

    The Law is the Law. If you break the Law you get punished. Justice is different from right, wrong fair or unfair. it is a condition of employment that your Mr K accepts when employing the maid. You cannot have one law for everybody. Laws are for ma majority. That is the way things are.

    If your Mr K takes the risk to break the law, then he must be willing to pay the price. If the maid complains he is in trouble. The maid may agree if properly compensated (this is the key issue), but who can be sure is will not be used as blackmail in future?

    There are good employers and good maids. I am sure this kind of thing happens more often than not. The cases that come up are the kind where one party takes advantage of the other in some way.

    This kind of hypothetical thinking shows me you have not lived in the real world. Unfortunately for you this cannot be fixed.

    Does it contravene the strict dictates of the law. Yes. It would be worse if it was not his office but his son’s premises.
    However, what is more important is if this is exploitative. In the scenario you have given, viz the maid has extra time, how much compensation could she extract and how much intimidation could she face. This is with respect to a normal HDB Ah Tan. How about if it was Mr. L. A prominent pillar of society. What should he do.? Uphold the law to the letter right ?

    The courts can be understanding. The household is wherever the family goes about doing family things. Shopping at IKEA or a barbecue in the park. Certainly not partying at Dad’s or Sonny’s office.

    If you feel the law on maid deployment is wrong, you ask Parliament to change it, or pay the agent to write an appeal to ministry of manpower to grant you special approval.

    Your cannot unilaterally decide to deploy maid ILLEGALLY. Especially when many other Singaporeans obeyed this maid deployment law and RESTRAINED themselves from illegally deploying maid. Don’t you think the hawkers, retailers, flyer-distributors, painters, assemblers, manufacturers, fish-ball factories, bee-hoon factories, etc would all love to deploy their maids at their businesses???

    Back to your above statement.
    Even if the maid really complained to MOM, what “trouble” will he get? At most MOM will only issue a warning to K not to do it again. That one called “trouble”? You said he paid the maid an “allowance” and now he has “no choice” but to pay compensation? Don’t come and bullshit la!

    I have been reluctant to fiack you for all your shallow and naive articles, but you never seem to grow wiser despite your age! I kept wondering how come you can become CEO of NTUC. They must have been blind to appoint you as CEO. No wonder people say NTUC means Never Trust Union Chief!
