Workers Party’ trio found liable for damages suffered by AHTC

Many would say “expectedly”, the trio from Workers Party  (WP), Low Thia Khiang, Sylvia Lim and Pritam Singh have been found liable for damages suffered by Aljunied-Hougang Town Council (AHTC).

In his judgment released on Friday (11 Oct), High Court Judge Kannan Ramesh ruled that Mr Low and Ms Lim had breached their fiduciary duties to AHTC and that Mr Pritam breached his duties of skill and care to the town council:

Their conduct was improper and the attempt to cloak the same with a veneer of truth and credibility collectively leads to the conclusion that they had not acted honestly and therefore breached their duty of unflinching loyalty to AHTC as fiduciaries.

Of the S$33.7 million paid to town council managing agent FM Solutions & Services (appointed without tender), the exact amount the trio will be liable for will be determined by the courts in a “future second stage of the trial”.

It is unlikely that the judgement will have any effect on the trio’s eligibility to contest in the coming General Elections as WP has supporters with very deep pockets and the party can easily crowd fund another million in a few days, which it did during the initial stage of the AHTC trial.

Besides, the amount of damages awarded will likely be ‘peanuts’ and nowhere near the S$33.7 million trumpeted by the local media since KPMG, the independent accounting firm appointed to audit AHTC’s account had stated that there was an alleged improper payment of slightly over S$1.5 million, but only about S$624,000 needs to be recovered.

So unless the trio is unable to pay the ‘peanuts’ awarded damages and are bankrupted, the 3 parliamentarians from WP will likely continue to remain as friendly co-drivers of the ruling party.

    I strongly believe in the correctness of the judgment.

    Based on the facts in the public domain and what’s reported in the press of the trial, I have already formed the opinion that those being sued, were liable for the plaintiff’s case.

    I wish to also remind sinkies that the WP had also shown their lack of fiduciary duties in the cleaning of the hawker centre managed by AHTC. What happened in that case should have proved that the WP was not party I would regard as having the integrity to hold public office as MPs.

    For those die-hard WP supporters, you are helping to dig your childrens’ grave and yours. In any case, the WP has styled itself as a “CO-DRIVE” with their supposedly hated enemy in the PAP. What an ironicla FARCE………..

    The Wayang Party MPs are good at giving excuses after excuses for their support of the PAPies…………..like Sylvia Lim defending the judiciary at the IBA meeting in Singapore in 2007; Low Thia Khiang support of PM Lee’s anti-China policies over the 9 dash-line China’s claims in the South China Seas; and publicly declared that the Wayang Party MPs are “CO-DRIVERS” with the PAP who is now claimed as their enemy.

    One of those farcical excuses given was that of the PAPies’ non-transparency…..when Philip Ang has showned conclusively that the PAPies INFLATE the medical fees & then claimed to have given huge subsidies. Philip Ang has also given the proof that panadol’s cost is around a couple of cents & yet the PAPies billed sinkies more than a dollar, if I remember correctly.

    And didn’t Law Minister defined what a charlatan is? Ha, ha, how come all those who blamed the 69.9% (or 70%) have not called out the Minister?

    Damn PATHETIC lot the Wayang Party members, IBs & supporters – only know how to thumb down people who point out their stupidity and lack of integrity.

    No one is surprised that WP are guilty, we already knew from the start when they were hauled to court what the verdict was already, no need for a 12 day wayang court hearing designed to waste everyones’ time and for something that the newspaper needs to print.

    PAP might think that this will cause WP to lose Aljunied, I’m pretty sure Aljunied voters are far smarter than PAP.

    So just as the election is round the corner the expected guilty verdict is also announced, how very convenient a timing hor?

    No one is quite bothered by this since more are angrier at the cost of living, lack of jobs, never ending transport fare hikes and the number of non Singaporeans being let in yearly.

In both instances, the lawyer is your fiduciary. This just highlights the difficulties of finding an all-embracing definition of fiduciary obligation.

    The other obvious difficulties and injustices to the defendants in any fiduciary duty litigation is the controversy of proscriptive and prescriptive dichotomy.

    Proscriptive tells you what NOT to do. Prescriptive tell you what you MUST do.

    The devil in fiduciary duty obligation law application is that IT IS SILENT ON PRESCRIPTIVE and in that omission, the defendant is adversely judged when omissions of UNKNOWN AND UNAWARED SILENT prescritives shaded out and overwhelmed the proscriptives as Dawson J, an Australian High Court would tell you.

    IT IS FINDING A BONE IN AN EGG law of judgement and outcome against the defendants in proceedings of “fiduciary obligations” law.

    DOES @ Realistically understands this iniquity?

    In layman term, you LOST BECAUSE YOU GOT SUED AND YOU ESCAPED LIABILITY WHEN YOU ARE NOT SUED.

    President Ong Teng Chong had publicly complained that he wasn’t given the full list of GIC (& Temasek’s) assets, and yet that did not prevent Philip Ang to call out the PAPies’ crap about medical subsidies, while the Wayang Party MPs give such excuses one after another for their failure to discharge their duties and responsibilities as MPs, without any SHAME about receiving their MP allowance of $16k month after month for more than 28 years, in the case of Low Thia Khiang…………for his only achievement of getting NEA to attend to the midges problem in Bedok.

    NO SHAME ONE………..just shows up their lack of integrity in their (mis)managment of the TC for which they are being sued.

    Perhaps when you are in WP’s shoes while thinking through with proper empathy and judgement of the surrounding conditions they are playing in, and realized that YOU, as a voter and ultimate game master once every 5 years or so (for now that is), are able to change the rules of the game to allow for any party to rightfully and properly serve the people to the fullest potential, or in your paraphrased terms, “discharge their fiduciary duties”, WITHOUT unfavorable conditions held against them, then we could talk about how one party is not as good as the other. Anything less is just, in your terms, “talk cock”.

    It all starts at the individual seeing beyond themselves, understanding the system they wish to perpetuate, the power they actually hold (for now) to make that happen, and the infallibility of their senses that prevents them from making that happen.

    Many have forgotten that the Wayang Party MPs failed or refused to provide basic cleaning service to the new residents of the AHTC numbering about 700 blocks even though the AHTC got the cheek to collect the monthly S&C charges.

    Many also have forgotten that the AHTC refused to clean the upper areas of the market during the annual spring cleaning unless those hawkers pay extra. The NEA had to step in to force the AHTC to do the cleaning FOC.

    The above incidents served to show the lack of integrity of the Wayang Party MPs of AHTC.

    Not forgetting that these said MPs have contributed NOTHING to improve the lives of sinkies through robust DEBATE to force or shame the PAPies to treat sinkies better eg. the Wayang Party MPs failed to debate the PAPies about the SHAM which the PAPies claimed to be subsidies in health care, only for Philip Ang to expose the PAPies falsehoods.

    Anyway, what can anyone expect of the Wayang Party MPs, as shown above in this post, when they SHAMELESSLY accept their $16k monthly MP allowance for their perfunctory wayang in Parliament?

    Every HDB residents paid the same S&CC charges. Is not that AHTC’s residents were demanded to be paying more S&CC charges OR the other way of looking at it is, other town councils should be saving extra equivalent of 33.7 millions more than AHTC if the over payments by WP are true.

    Hence all other town councils should demand their MP to show at least 33.7 millions savings in the town council accounts and demand to be paying less S&CC charges.

    WP should demand an investigation into it.

    Low Thia Khiang and Sylvia Lim, being defendants of PM Lee’s policies surely have confidence in the judiciary – having supported the PAPies as co-drivers and for Sylvia Lim to have defended the judiciary during the International Bar Association meeting in Singapore.     Many of us have differing views.

    But given it is an opposition party managing a GRC TC, WP knew it would be under the spotlight. And PAP is a Long time incumbent with a machinery in place for many years, with the benefit of learning and honing over those years. With these factors in mind, WP should have known better, and should have had the cow sense to know that there is a line they have to toe.

    It is absolutely pointless in finger pointing at the PAP’s own shortcomings, making potshots at the 70% PAP voters, etc. It is a total waste of everyones’ time to follow this sort of wild and endless blame apportionment that seems to go back further and spread wider with each passing post. Such posts are simply not worth the effort reading or processing.

    WP leaders will not and cannot know everything. That is a fact of life for many leaders. But leaders also have to choose (1) when to make their personal judgements on certain issues; and (2) when to ask for input on issues they are unfamiliar with. On Point (2), the outcome is very much dependent on (a) whose counsel the WP seeks; and (b) the extent to which WP decides to rely on the counsel of these individuals. There is a lot of judgement involved. Not every person is to be extended the same level of trust and confidence. And this is what distinguishes the job of a leader from a worker/follower. Pick the wrong counsel, place inappropriate level of trust in that counsel, and it is all over before you realise.

    WP played its cards poorly in this respect, and underestimated how this could be put together as a series of actions that inferred that they had no intention to even pay lip service to basic governance rules. It is as simple as that.

    But even if that is so, FMSS has to be put through the paces of the TC tenders and awards processes. And when appointed, those conflicts of interest should have been addressed.

    WP made a whole series of fatal errors in this regard. It was not just one or two. It is unacceptable to place this level of blind faith and trust to this extent for any organisation that handles public funds. And it is crystal clear that WP just underappreciates the importance of this.
