Lawyers for liberty seeks declaration from Malaysian courts…

Through a Facebook post on Thursday (23 Jan), international human rights lawyer M Ravi said that he has received a note from his Malaysian colleague N Surendran that the latter will be taking out an application in the Malaysian courts against a “Singapore Minister” to seek a declaration that “POFMA will not have application to Malaysian citizens” (sic).

Earlier, Malaysian human rights group Lawyers for Liberty’s press statement (16 Jan) alleging that brutal execution methods have been used at Changi Prison. Minister for Law and Home Affairs K Shanmugam then invoked POFMA against the statement, with the Ministry of Home Affairs saying that “these allegations are entirely unfounded.”

The note from Surendran read:

Dear all,

Kindly take note that we will be filing a legal action against Singapore Minister for Home Affairs K Shanmugam regarding the Correction Direction pursuant to Singapore’s Protection From Online Falsehoods and Manipulation Act 2019 (POFMA), which was sent to LFL on 22 January 2020.

Details are as follows:
Date: 24 January 2020 (Friday)
Time: 10.30 am
Venue: Lobby, Kuala Lumpur Court Complex.

Counsel Ambiga Sreenevasan and Gurdial Singh Nijar will be present.

All are invited to attend.

Lawyers for Liberty

Both counsel are prominent lawyers in their own rights. Dato’ Ambiga Sreenevasan was one of the eight recipients of the US International Women of Courage Award while Dato Dr. Gurdial Singh Nijar Law had been a Professor at Malaysia’s top university – University of Malaya’s – for 16 years.

While there are no details of the lawsuit as at press time, it is expected that more media coverage will be given to the case.

Ravi concluded “Honestly Singapore is embarrassing itself.. It’s shameful when we citizens have allowed the government to go to this extent”

    POFMA is a Singapore law and should not be binding in Malaysia or USA or UK and I do not believe it has jurisdiction in any other countries other than Singapore right?

    Why is a Malaysian agency taking action in a Malaysian court against a Singapore Minister then since any ruling from within Malaysia also has no jurisdition in Singapore?

    WHat declaration they seeking since its obvious countries like France, USA or UK won’t even acknowledge POFMA?

    Most likely the Minister will borrow a finger from Mdm Ho’s monkey and send it to the plaintiff.

    Actually not sibei correct lor. If you read the POFMA correctly hor, it is extra territorial and therefore can apply to a Malaysian even if the offending post is made in Malaysia.

    The extra-territoriality clause within POFMA states that “a person who had spread falsehoods online outside Singapore may be dealt with as if the offence had been committed in Singapore.

    So, if the Malaysian offender don’t come into Singapore then all happy go lucky but if he enters Singapore, then he can be arrested and dealt with under the provisions of POFMA.

    Therefore hor, if any of the Malaysian lawyers from LFL ever enters Singapore, they can be arrested and “taken care of” under the POFMA.

    Scarry right?
