AGC Adds Insult To Injury On Liyani’s Case

I refer to this article on TNP.

Basically, after Ms Parti Liyani’s wrong conviction (that was eventually overturned), resulted in 4 years worth of loss in income, huge monetary expenses from the pro-bono lawyers and humanitarian groups that helped her, (not to mention their own personal sacrifices). But despite her losses, she cannot claim more than $10,000.

Ms Liyani could have pleaded guilty and serve 2 years of time, but instead she maintained her innocence and perservered.

And what was her reward? A second slap to the face by the AGC! (No, not a literal slap. I have to make that clear, or else, you know?)

Anyway, negotiations with the AGC have broken down. I can only assume that it means they told her to go fly kite. Wow. Literally adding insult to injury. Asked for a mere fraction of what she lost, and the answer is no.

Even if AGC had agreed to compensate her, it’s not like the money is going to come out of their pockets anyway. So why is AGC refusing to negotiate? I don’t know the reason. But I can guess.

My first guess. As far as the AGC is concerned, THERE WAS NO MISTAKE. Just because her conviction was overturned, doesn’t mean the AGC made a mistake. THE AGC HAS NEVER MADE A MISTAKE AND WILL NEVER MAKE A MISTAKE. They want to make sure the public knows that.

Second guess. They want to make sure they don’t set a precedence. A precedence that someone screwed by the system, can just saunter up to them and demand money. If you got screwed, blame it on your own bad luck!

Again, these are just guesses. Nothing more than speculation.

Anyway. To conclude, perhaps its time we consider very carefully if some personnel should be replaced.

    It was the judge who subsequently recommended out-of-court mediation with a third party to help both parties settle on a confidential amount of compensation.

    BUT

    Mr Anil replied that while he will consider the prospect of mediation, he and his client are of the view that there has been “some amount of injustice that they wish the court to hear and order compensation”.

    It implies that Mr Anil had outright rejected the offer to negotiation and wanted to get the court to order the compensation.

    So, how do you think the AGC can save face from such situation?

    Response : What happen to Parti Liyani during that 4 years worth of loss in income ? Was she inside jail or was she outside jail but still in Singapore ? Whose house is she living with if she is still in Singapore then ???? Did she ever serve jail since she got a wrong conviction ?

    Well if she win the case ,at most she got $10,000 ? So surely this is another technique to make people give up fighting any winning court case against the authority ? $10,000 is not enough to pay any lawyer fees for a long period .However,not to worry,all those evil women wing will behind pump and transfer a lot of million donation coronavirus$$$ to her eventually and her beast brain will get damage from seeing those coronavirus$$$ and become dumb and keep her mouth shut .That woman public prosecutor who is said to wrong her no need to go to jail meh ?     Jailed Over One Dollar Bribes
     
                There is no limit on the bribe amount that the Corrupt Practices Investigation Bureau (CPIB) can and will investigate, even if the amount is as small as one dollar. A bribe of one dollar is still an offence. 
    2          On 10 January 2019, a forklift operator employed by Cogent Container Depot Pte Ltd (“Cogent”) was jailed for corruption. Chen Ziliang (陈子良), a 47-year-old male, was sentenced to 2 months’ imprisonment and ordered to pay a penalty of $4,870.50, for embarking on a course of conduct to obtain bribes from truck drivers at Cogent.
    3          Chen was responsible for operating forklifts for the loading or unloading of containers for truck drivers. Investigations by the CPIB revealed that in October 2017, a truck driver had confronted Chen after having to wait for a considerably long time in the queue. Chen then informed the driver that it was the norm for truck drivers to pay one dollar, or risk having to wait longer in the queue or be given containers that were in a bad condition. 
    4          In March 2018, when Chen was arrested by the CPIB, coins amounting to $2 were found on the mudguard of the forklift operated by Chen. 
    5          Subsequent investigations revealed that Chen had in the course of his employment with Cogent, had obtained bribes of $7 to $10 daily from truck drivers so as not to delay the collection or return of containers from or onto the vehicles of these truck drivers.  Chen embarked on this corrupt practice from 1 February 2016 up to 12 March 2018 and it was estimated he had obtained approximately $4,872.50 in bribes. As a result, he was charged with the practice of corruptly obtaining gratifications from truck drivers at Cogent, as an inducement to not delay the collection or return of containers onto the vehicles of these truck drivers, an offence punishable under section 6(a) of the Prevention of Corruption Act, Chapter 241, which is an amalgamated charge pursuant to section 124(4) of the Criminal Procedure Code, Chapter 68. 
    6    Singapore adopts a strict zero-tolerance approach towards corruption. It is a serious offence to obtain bribes, or attempt to obtain bribes from another individual or entity. Any person who is convicted of a corruption offence can be fined up to $100,000 or sentenced to imprisonment of up to 5 years or to both. 
    7    The CPIB looks into all corruption complaints and reports, including anonymous ones, and can be reached via the following channels:

    Surely her lawyer must have explained it to her and the only reason I can find why she choose to sue the AGC is because she is not interested in the petty 10k, but wants the court to find the AGC “guilty” and action on the 2 DPPs.

    Besides, she already reportedly got more than 30k in donations from kind Sinkies and maybe don’t need another 70k from Liew anymore? (remember Huang Na?).

    $70,000 is a LOT of money and I’ll be a fool to let it go considering that he tried to fix me and land me in prison for 2 freaking years.

    It was a quote from Liyani that Liew had suffered much on this and she worked for quite a while with the family amply Paid and fairly treated I believe, the qualm is with the son and his side of the family that she was unhappy about and her veiled threat of reporting to the authorities was meant for the SON, not Liew pe se…Liew had to take the action of dismissing her as Blood is Thicker THAN water…ask the wooden piece of SHIT, I will not sue but SUE if he is NOT my brother…I wonder what has he to say about his SON

    Reported on Straits Times :Quote -”SINGAPORE – The personal information from 2.8 million Eatigo accounts belonging to users from Singapore, Hong Kong and Thailand has been stolen and put up for sale on an online forum.

    In an e-mail to customers on Saturday (Oct 31) seen by The Straits Times, the online restaurant reservation platform said the information stolen was illegally accessed more than 18 months ago and included names, e-mail addresses and phone numbers.

    “We were made aware on Oct 30th that along with several other e-commerce platforms, we were the subject of a data security incident,” the company said.

    “Your existing eatigo account password is protected by encryption and hence safe. We do not store credit card information on our system.”

    News of Eatigo’s data breach comes just a day after e-commerce giant Lazada confirmed that personal information from 1.1 million RedMart user accounts had been stolen.

    Both sets of information were put up for sale on the same website.

    The stolen Lazada information was also more than 18 months old but it is not known if the two incidents are related.

    In its e-mail, Eatigo said it will collaborate with the relevant authorities on this matter and has set up a support team that affected customers can reach out to with queries or concerns.

    It also advised customers to log into their accounts and reset their passwords as a precautionary measure, and to be alert to any spam e-mails requesting personal or sensitive information.

    Good that the Honourable Justice Francis Chan Seng Onn pointed out the ridiculous limit to Parti Liyani’s Lawyer Anil.

    Sad that the Ministry of Law did nothing all these decades.

    Of course, it is more pathetic that the party which caused all the trouble for Parti Liyani in the first place has not reach out to her to offer compensation.

    Maybe they would like to but “face” is a stumbling block.

    Letting The Law take its course may be the only option but what justice do we have?

    Reported on the Independent.sg :Quote – “Singapore — In his Ministerial Statement on the case of former domestic helper Parti Liyani, Law and Home Affairs Minister K Shanmugam told Parliament on Wednesday (Nov 4) that she was charged with theft in August 2017 because the Attorney-General’s Chambers felt that there was sufficient evidence and it was in the public interest to do so.

    The statement was made after the case raised questions about the country’s criminal justice system following the acquittal on appeal of Ms Parti two months ago.

    Mr Shanmugam stressed that it was treated as a routine theft case and that there was no attempt by anyone to influence how it was dealt with.

    It began with the filing of a police report in 2016 by Ms Parti’s former employer, Mr Liew Mun Leong. He was at that time chairman of the Changi Airport Group….

    Mr Shanmugam said that, after she was arrested, Ms Parti admitted taking 10 to 15 items of male clothing without permission.

    In addition, her explanations for some of the items she was accused of stealing changed from one statement to another.

    According to a straitstimes.com report, Mr Shanmugam noted how, for example, on Dec 4, 2016, she had said in a police statement that two watches, one a “Vacheron Constantin” and the other a “Swatch”, were gifts from a friend.

    However, in a later statement on May 29, 2017, she changed her story to say that she found the two watches — which turned out to be counterfeits — in the trash of Mr Liew Mun Leong’s daughter May.

    Ms Parti also claimed that she had found some jewellery in the trash but Ms Liew said she never threw jewellery away and gave any unwanted jewellery to the Salvation Army or to friends.

    Mr Shanmugam said: “It appeared that Ms Parti had stolen many items, including seemingly expensive items. It appeared she had been stealing for years, and it was not impulsive, spur-of-the-moment decisions.”

    On whether there had been a break in the chain of custody of the items, Mr Shanmugam said that this did not affect every single item in the case.

    The trial judge had found Ms Parti to be untruthful, after hearing evidence from 12 prosecution witnesses and four defence witnesses. She was convicted in March 2019 of theft and sentenced to two years and two months in jail.

    During the 3-day appeal hearing in September 2020, the High Court, however, came to a different view. The judge allowed the appeal because he was troubled by the unreliable statements made by Mr Liew’s son Karl.

    The High Court’s acquittal is final and there can be no appeal, said Mr Shanmugam. He added that his statement was not an exercise of reopening the judgment. /TISG”Unquote.

    Response : What type of justice system is this that the high court’s acquittal is final and there can be no appeal? If the judgement is wrong, it need to remove and charge the judge too for wasting public funds. A court case is expensive, judge cannot make mistake and let off! Pui!
