Repeal of S377A

I don’t understand why our judiciary cannot be allowed to rule on the constitutionality of laws passed by parliament. Messiness cannot be a legitimate excuse to remove their powers which are guaranteed by our Constitution.

We see in this debate that the PAP whip is not lifted when it comes to voting on S377A and amendments to our Constitution. This amounts to forcing PAP mps to vote in favour of the bills in order to obtain majority votes. We can therefore conclude that the PAP mps do not represent the views of their constituents but the views of the party.

    Nobody call themselves People’s Representatives, citizens’ representatives.

  • Who else but PAP Politicians ?:

    Something is very wrong with our PAP styled Parliamentary System. If the Judiciary cannot be trusted to deal with our Constitutional matters, it looks like only our PAP Law Minister (via the MPs?) has that responsibility solely. I thought our Judiaciary are of the best minds and yet now in this case it seems our MPs are more qualified than our honorable judges. (.Note : They seems to be praising Andrew Phang in the mainstream media).

    Or is it another case of having the cake and eat it too.

    Firstly wasn’t it not too long ago it was our PAP MPs were fighting tooth and nail about retaining 377A. All sorts of arguments were used to justify its retention. Now that the world political trend is navigating towards a more friendly LGBT cause because it no longer makes any political sense towards making enemies from the LGBT community especially in marginal constituent seats where every vote counts. That is probably why they had to throw their spanner to WP MPs to make their LGBT stands known to the public.

    Looks like our WP MPs got trapped by their morality stands.

    I am very sure that there are many Christians, liberal, or Bible-believing PAP MPs in Parliament. I believe many have their personal views on the repeal of section 377A of the Penal code and are prevented from voting against it based on their conscience. Is this how Parliamentary democracy works?

    Why should the Law Minister criticise Pritam Singh on lifting his Party Whip to let his fellow WP MPs vote according to their consciences when the PAP did the same thing in 1969 in passing the Act to legalise abortion? Wikipedia- ‘the parliamentary whip was lifted for this vote, allowing votes to accurately represent the members’ opinions. It was passed… with 32 for, 10 against, and one abstention.’ Because it meant terminating life in the womb, not a decision to be taken on a whim.
    By lifting his party whip, PS perhaps recognised the qualitative changes in society following the repeal … eg gay nightspots need not be so discreet about their existences, gays can openly show their love on public premises, gay events/conventions/etc may be held like the usual IT fairs etc with police permits (recall Nation Parade at Sentosa before the authorities caught on), gay brothels in Geylang(?), gay books and magazines may be wrapped, shelved and sold to over-18s in major bookstores, you readers add to the list and correct where needed … and inevitably the petition for gay civil unions to ‘make him an honest husband.’
    In other words, with this repeal, Singapore is perhaps the only country in SE Asia or even Asia where gays are free to live the love that dare to speak its name, without violating the laws on public order and decency as similarly applied to straight men. Because permission, for want of a better word, has been given in black-and-white.

Can the decision to repeal 377A be challented in Court, let’s say by a religous group that wants to keep it in the Constituion? That is, ssuming there is a separation of powers between the judiciary and legislature.

    In this rare instance, I agree with the PAP. We operate on the Westminster system of parliamentary supremacy.

    Under our Constitution (whether you like it or not,) the job of the legislature is to make amend or repeal laws. And this is just what PAP did.

    The Judiciary’s job is to interpret the Laws made by Parliament. And this is what they shall do after the Laws are made.

    If you do not like the Government of the day, then vote them out and control Parliament and change the Laws. If you cant vote them out, then live it or migrate if you can.

    If Laws passed are unconstitutional, the Court’s job is to strike it down in a judicial review.

    If our PAP Government were to rule Japan, it would mean our Goverment leaders especially our Law Minister and our PM-in-waiting Lawrence Wong would be violating human dignity by banning same-sex marriages isn’t it ?

    That would be my interpretation of a Japanese judge’s ruling on the matter.

    Lawrence Wong has already ruled out same-sex marriage during his watch as if he already has the mandate to do it. I personally think it is rather arrogant of him to say it so prematurely even before he is re-elected again. What if he is rejected by the electorate ? Anything is possible politically nowadays.

    IMHO, I predict one fine day Singapore will change its political stand towards same-sex marriage once the PAP start losing its constitutional seats to the opposition in the future. Just mark my words especially with a calculative PAP Goverment who is too scared to lose anything !

    A win for the LGBTs. Now, gay people can come out of their hiding. The LGBT community can help PAP make SG a Rainbow City by bringing in the alternative lifestyle into mainstream society! More gay bars and enterainement; rainbow flags and banners; public expression of affection (hugging and smooching); publications promoting the alternative lifestyle; more pink events (festivals and parades), etc. They might even press the PAP for equal representation in Parliament or join the Opposition in the next GE and perhaps win a seat or two. Forward SG! When PAP stood strongly against the removal of 377A, the religiously “white” were lending their voices in support of its retention. Why didn’t they come out as strongly this time to protest it’s removal? Have they been betrayed?
