Day 1 of ICJ hearings in genocide case against Israel in Gaza

Watch the full proceedings of the first day at the International Court of Justice (ICJ) hearing for South Africa's genocide claim against Israel in Gaza.

ICJ is one of the six principal organs of the United Nations (UN). South Africa asked for an emergency order calling on Israel to suspend its military campaign, which it launched after an attack by Hamas-led Palestinian fighters on 7 October, which killed 1,140 people, according to Israeli officials.

The state filed the lawsuit at the end of December, citing statements made by Israeli public officials and the actions of its military.




It is the first time Israel is being tried under the United Nations’ Genocide Convention, which was drawn up after the Second World War in light of the atrocities committed against Jews and other persecuted minorities during the Holocaust.

    ICJ closed their eyes and ears when mass torture and death was happening, with full evidence and boasting by the evil forces. Until now, many years later, they still shut their eyes and ears.

  • If I remember correctly, donkey years ago, the ICJ ruled that Israel was an “occupying force”, so it has no right to self-defense, this also pertains to Palestinians, I think it was West Bank. Israel then ignored the ICJ’s ruling and the whole world lan lan. So what makes anyone think that Israel would guai guai accept the ICJ’s ruling this time round and not show ICJ its middle-finger?

    Besides, ICJ is under United Nations, which is owned by the US. Israel is protected by the US in everything it is doing to the Palestinians in Gaza. Say if ICJ rules against Israel, it has to go to the UNSC to enforce it and remember that US has veto powers.

    So this whole charade is just for show, although I am sure South African has every good intentions.

    As long as the warmongering US is protecting Israel, there is NOTHING the entire world can do about it, period.

    I for one was shocked to see this kind of hypocrisy from a country who suffered through decades of damage from apartheid which denigrated their own people. And let’s not forget the other hypocritical farces that come out of South Africa, including its sanctimonious and loathsome baiting of Israel for supposed human rights abuses. The blatant hypocrisy displayed here makes its criticism of other states and its repetitive focus on Israel, despite the massive slaughter going on in the rest of the Middle East and the world including Africa, incredible to say the least.

    Ironically, South Africa is the most vapid anti-Israel sub-Saharan government in Africa. It is the birth place of The Boycott, Divestment, Sanctions (BDS) movement. Its attacks on Israel are always spiked with wild exaggerations or outright falsehoods. I find it extremely disingenuous that once South Africans obtained majority rule, ending the 10% minority white rule which left 90% of the population disenfranchised under Apartheid, they reject the same principles of majority rule for Israelis, who seek to exercise those very same rights.
    Mr. Mandela must be turning in his grave.

    Their position on the role of human rights in its foreign policy has been contradictory and paradoxical. To reconcile a commitment to democracy and human rights with ‘commitments to African solidarity and anti-imperialism’, leading to an incoherent and inconsistent foreign policy with regard to protecting and promoting human rights? A mixture of competing ideologies and regional and global constraints which shape its human rights foreign policy, including in the case of Bashir. This disgusting policy, equally as much as the double standard in the kid glove treatment of Omar el-Bashir, exposes the current South African government as dominated by the most vile cabal of hypocrites. The blatant hypocrisy displayed makes its criticism of other states and its repetitive focus on Israel, despite the massive slaughter going on in the rest of the Middle East and the world including Africa, incredible to say the least.

    The government clearly gave Bashir assurances that, notwithstanding the ICC arrest warrant, his immunity would be respected in SA for the purposes of his attendance at the AU meeting. That was a regrettable decision (though unsurprising, given the broader diminution of support for the International Court of Justice project), but once implemented, it was irretrievable. To give the assurance and then to renege would have violated a cardinal rule of statecraft. Thus, compliance with the court order could not reasonably have been expected. The best-case scenario would have been to make Bashir persona non grata, albeit at the rather steep cost of putting SA at odds with the collective will of the African states that it seeks to lead.

    Dream? Ships using the Red Sea are changing their identity to Chinese, not American or British. If you get rid of your colonial mindset, you will be able to see how much influence the Chinese have in the Middle East and the African continent. The US and UK will be condemned just like Israel for the genocide in Gaza. A power vacuum is being created because of poor US and UK leadership and this will raise China into power.
