Why Singapore should strengthen laws to protect retrenched workers- Today online, 26 January 2024.
I fully empathise with the author of the above story because I was once like him/her and everywhere I looked or approached for help, I drew a blank.
Below is my personal retrenchment story.
Some years ago, I worked as a junior executive for a public listed company that is listed on the Singapore Stock Exchange for more than 5 years until I was retrenched along with a number of my other colleagues.
To cut a long story short, I approached my HR about my retrenchment benefits and I was told that I am not entitled to any because there was nothing mentioned in my employment contract regarding retrenchment benefits.
I was told that I wouldn't get 4 weeks pay for every year of service or even 2 weeks pay for every year of service. Nothing at all! I was devastated and desperate.
MOM and Tripartite Alliance for Dispute Management were totally, totally hopeless in the hours when you needed them most.
Later on, somebody told me that MOM will only take on our case about unfair retrenchment if 5 or more staff from the same company make similar complaints otherwise they will simply view it as an employment dispute between employer and employee only. That information that I was told could be right or wrong.
I even e-mail my Board of Directors (BOD) and the reply that I got back from them was that even if they want to pay me, the company had no money to pay. I knew that was a whole lot of bull. I am sure that even when the company was retrenching staff, they knew how to pay themselves one way or another.
I told my HR and I believe the BOD too (cannot remember too clearly now) that if I do not get a reasonable compensation package, I will post my unfortunate experiences online, no more and no less and which is something that I am good at doing with the intention of shaming the company and warning others about them.
Shortly thereafter, I received an offer, a satisfactory handshake package with one, stern reminder not to tell my other affected colleagues and two, that compensated amount would not attract CPF contributions.
Our employment laws regarding retrenchment benefits are stacked real high against employees.
If Singapore seriously aspires to attract quality foreigners and be a successful business hub in Asia over the long term and with changing times, this white elephant badly needs fixing and it is only in our collective interest to do so with urgency.
Cost of living is really expensive in Singapore and many workers have families and mouths to feed and that depend on them staying employed and receiving reasonable compensation packages when they are being retrenched.
This experience and a number of others are the reasons why I distrust and despise this pap government despite them having generals and scholars in the midst and all their clever talking in and outside Parliament.
