新加坡大法官陈锡强 （新加坡29日讯）新加坡大法官陈锡强说，法庭没有包庇政府，因为自1957年以来，每10起百姓起诉政府机构的案件，就有3起是百姓胜诉。 陈锡强是在9月版的《新加坡法学院期刊》中的一篇文章，提及这样的数据。 他说，自1957年以来，法庭接到79起民众向法庭申请进行“司法审查”的案件，这其中，有22起的申请人最终都从法庭的判决中讨回了公道。 所谓“司法审查”，是指申请人认为，政府机构的决定对他们不公正，要求法庭对政府机构的决定进行审查。 这79起案件的内容包罗万象，从不满被政府机构解雇，到不满政府征收他们太多税都有。 大法官说，法庭的责任是秉公处理案件，他否认一些人指本地法庭听命于政府，对政府机构的错误视若无睹的指责。 案件根据法律判决 他说，所有的案件都是根据法律来判决的，公共机构无理，百姓就赢；百姓无理，当然就输。 受访的律师表示，一般上，老百姓如果觉得政府或公共机构对他们不公平或不合理，都能告上法庭，自行或聘请律师采取法律行动，入禀高庭讨公道。 王立清律师说，老百姓通过“司法审查”讨公道，在国外尤其美国和英国相当普遍，不过在新加坡，有很多人其实不晓得有这个途径。即使知道，他们或许也会认为，要起诉政府机构过程是困难和沉重的，最终也选择作罢。   作者：星洲日报 来源：http://www.sinchew.com.my  Read More →
