Anyone can be referred to the Court by the UN Security Council… but since America has a veto it seems unlikely any of the US or Israeli citizens cited by the UN and its agencies for breach of international law will be referred to the ICJ – which Washington applauds for charging others, but derides in relation to prima facie cases against Americans and their friends.

Why has the U.S. not signed on? Only one of the few nations to not be a signatory to the International Criminal Court, also known as the Rome Statute. It came into force on July 1, 2002, with 123 nations signed on, including Canada, France, Germany and Italy. Also Afghanistan. Absent from the list are China, (read) ISRAEL, Russia and the United States.

I’ve often wondered at the hypocrisy of holding other nations accountable while pretending that US is above the law (international law, that is). This is a sobering reminder, that the international “rules based order” ends, where the US interests begin. Interesting how the same three countries that have failed to sign up to the ICJ happen to be the UNSC members that most frequently abuse their veto power.

The Biden administration has been unable to achieve its goals regarding Israel’s war in Gaza, including greater restraint and a postwar path towards peace AND over 23,000 Palestinians have been killed so far, and the threat of mass starvation and disease looms. Israel had signaled a shift in its war strategy, using fewer troops and focusing more on central and southern Gaza. However, these shifts do not seem to dial back regional tensions or prevent the increasing humanitarian suffering.

IMHO, President Biden should make a course correction by exercising diplomatic and military leverage to move Israel in the direction of U.S. interests, including embracing the need for a full cease-fire, limiting the transfer of further military supplies to Israel, and creating oversight mechanisms for the use of American weaponry.

Thousand or a few thousands have been killed in the cross-fires between Hamas and Israeli soldiers no doubt.
