PM Lee has filed a court application for a summary judgement against blogger Roy Ngerng late yesterday night (10 Jul) [Link]. According to online information, a summary judgement is described as [Link]: A procedural device used during civil litigation to promptly and expeditiously dispose of a case without a trial. It is used when there is no dispute as to the material facts of the case and a party is entitled to judgment as a Matter of Law. The purpose of summary judgment is to avoid unnecessary trials. It may also simplify a trial, as when partial summary judgment dispenses with certain issues or claims. For example, a court might grant partial summary judgment in a personal injury case on the issue of liability. A trial would still be necessary to determine the amount of damages. Two criteria must be met before summary judgment may be properly granted: (1) there must be no genuine issues of material fact, and (2) the Movant must be entitled to judgment as a matter of law. A genuine issue implies that certain facts are disputed. Usually a party opposing summary judgment must introduce evidence that contradicts the moving party's version of the facts. Moreover, the facts in dispute must be central to the case; irrelevant or minor factual disputes will not defeat a motion for summary judgment. Finally, the law as applied to the undisputed facts of the case must mandate judgment for the moving party. Summary judgment does not mean that a judge decides which side would prevail at trial, nor does a judge determine the credibility of witnesses. Rather, it is used when no factual questions exist for a judge or jury to decide. The moving party has the initial burden to show that summary judgment is proper even if the moving party would not have the Burden of Proof at trial. The court generally examines the evidence presented with the motion in the light most favorable to the opposing party. Where the opposing party will bear the burden of proof at trial, the moving party may obtain summary judgment by showing that the opposing party has no evidence or that its evidence is insufficient to meet its burden at trial. If PM Lee is successful in getting a summary judgement against Roy, a lengthy trial would be avoided. Mr Lee is currently suing Roy for defamation over information posted by Roy on his blog, The Heart Truths. To avoid summary judgment being entered against Roy, Roy has to show that the dispute concerns a triable issue or that there is some other reason for going into trial. In the application, Mr Lee’s lawyers sought damages and asked the court to stop Roy from publishing or disseminating allegations that Mr Lee is guilty of criminal misappropriation of the monies paid by Singaporeans to the CPF. On the grounds of this court application, Mr Lee’s lawyers added that Roy has no defence and the only issue to be determined is damages. Mr Lee’s lawyers also provided the affidavits of seven others, together with Mr Lee's, in support of this application: It's unclear what is the relationship between these 7 people and Mr Lee. Mr Lee is also seeking costs from Roy. “The Court has jurisdiction and this is the proper case to determine the natural and ordinary meaning of the offending words and images,” Mr Lee’s submission said. Roy had earlier complied with demands made by Mr Lee, including issuing an apology, removing the offending article and four others, and making an offer of compensation, which was subsequently rejected by Mr Lee, who described the S$5,000 offer as “derisory.” Mr M Ravi, who is Roy's lawyer, will resist Mr Lee's application for summary judgement. iknowtherealissue: Foreign workers and PMETs are two different issues, the government keeps using this to defend their import of millions of PMETs into Singapore! I know the real reason behind the closure, I ate at Lei Garden from 2007.. and stopped eating last 2 years. Why? The prices tripled!!! Even Crystal Jade which is the same grade is cheaper by 30% for the same food. The company used to eat every CNY lunch there, the bills tripled, so we decided to move to Crystal Jade. The situation is for many years, wages remain stagnant. If meals are so damn expensive, who will dine there? And I personally saw the customers getting fewer and fewer, not because the food is bad but it is ridiculously expensive!! Look at Jumbo, it has been doing so well for so many years. Why? the prices are reasonable and affordable!!! Lei Garden is following government style of relentless increase in prices and eventually no one can afford cars, HDBs and even hawkers anymore. Is that what the government wants???  * * * * * * * FT good, slaves even better: I am dismayed with this PAP minister who lamented the closure of Lei Gardens, jumping to his ministerial conclusion that Lei Garden closed because of lack of plentiful cheap labour. My question to LSY is, “Is this the only reason why Lei Garden closed?”. What kind of half baked minister that takes LG’s excuse without verification. If he had checked, he will realize that LG close primarily because of the abundance of many other better restaurants for the price they are charging, AND they have to charge those prices primarily because of high rentals in Orchard Road AND finally, because Singapore is now facing an economic slowdown. It was simply too many premium restaurants chasing the same well heeled customers. Off course restaurants that has been operating with plentiful cheap labour will now find it difficult to find enough experienced Singaporeans to fill the gap…because the “cheap FT” PAP policies of the last 10 years had driven Singaporeans away from F&B. Citizens can see how damaging PAP’s cheap FT policies have been when even a 5% reduction in DRC from 50% to 45% could cause Lei Gardens to close. Has LSY has just shot PAP in the foot by exposng the aftermath of a horrendously damaging PAP FT policy OR is LSY echoing the greedy desires of restaurant owners by asking for a reinstatement of the DRC to 50%. Why stop at 50%, might as well revive the slave trade.
